Under California law, a person or corporation can be held liable for personal injury if it's more likely true than not that they owed the injured or deceased person a duty of care, breached that duty, the breach caused the injury or death, and the breach resulted in damages, whether economic, non-economic or both.
California follows a pure comparative negligence rule, which lets a claimant recover damages even if a judge or jury assigns 99% of the fault to them, meaning you can still recover the remaining 1%.
