How is fault established?

Under California law, a person or corporation can be held liable for personal injury if it's more likely true than not that they owed the injured or deceased person a duty of care, breached that duty, the breach caused the injury or death, and the breach resulted in damages, whether economic, non-economic or both.

What happens if I'm partially at fault for the accident?

California follows a pure comparative negligence rule, which lets a claimant recover damages even if a judge or jury assigns 99% of the fault to them, meaning you can still recover the remaining 1%. That's why you should never accept fault at the scene, or in a recorded statement to an adjuster, or even in a remark on social media.

How long do I have to file a personal injury case?

The general rule is that the statute of limitations on an injury case is two years from the date of the accident, and in wrongful death cases it begins running two years from the date of death. There are exceptions that can shorten this to as little as six months, which is why it's better to consult a lawyer as soon as you can after the accident.
